This policy applies to Newy 87.8 FM and newy.com.au (“Newy”, “we”, “us”, “our”).

WELCOME

We’re in the business of music, local news and community stories, not collecting more personal information than we need. This policy explains how we handle personal information when you visit our website, listen online, contact us, interact with us on social media, request a song, or send us photos, videos, tips or other material.

1. THE QUICK VERSION

We collect the details we reasonably need to run the website, respond to you, verify content, publish or archive material, improve the service and meet legal obligations.

We do not sell or rent personal information, your information is handled by humans in Newcastle NSW Australia, we are local.

If you send us photos, videos or news tips, we keep the identity of the submitter private by default unless you ask to be credited, or we need to disclose something for verification, legal, safety or complaint-handling reasons.

2. WHAT WE MAY COLLECT

Depending on how you deal with us, we may collect:

– your name or nickname;
– your email address;
– your phone number;
– the contents of your message, song request, tip, complaint or enquiry;
– photos, videos, audio files, documents or other material you send us;
– details needed to verify a story, confirm ownership or permissions, or respond to you;
– technical website data such as IP address, device/browser information, pages viewed, approximate location and access times;
– information you make public, including on social media or in public records, where relevant to our work.

Please do not send bank details, ID documents, medical information, children’s personal information or other highly sensitive material unless there is a clear reason and a lawful need for us to handle it.

3. HOW WE COLLECT IT

We collect information when you:

– use our website or stream;
– fill in a form or request a song;
– email, call, message or DM us;
– interact with us on social media;
– send us photos, videos, tips or other material.

Sometimes we collect information directly from you. Sometimes we receive it from someone else or from publicly available sources. Where it is reasonable to do so, we will take steps to make people aware of that collection or point them to this policy.

4. WHY WE COLLECT IT

We use personal information to:

– respond to messages and requests;
– review, verify and assess news tips and submitted content;
– contact submitters, witnesses, organisers and other relevant people;
– publish, broadcast, archive or promote content;
– protect people and property;
– manage complaints, corrections and takedown requests;
– improve the website and streaming service;
– keep records, prevent misuse and secure our systems;
– comply with the law.

Where overseas privacy laws apply, our lawful bases may include consent, steps taken at your request, compliance with legal obligations and our legitimate interests in operating a local media service, running our website, securing our systems and investigating or publishing community news where lawful.

5. SENDING US PHOTOS, VIDEOS, NEWS TIPS OR OTHER MATERIAL

This part matters.

If you send us photos, videos, audio, documents, tips or other material, we will keep the identity of the submitter private by default. We will only publicly credit you if you ask to be credited, clearly agree to be identified, or it is otherwise reasonably necessary and lawful. To receive a credit, tell us how you would like to be named.

We may still use your contact details privately to verify the material, confirm permissions, ask follow-up questions, respond to complaints, protect someone’s safety, or comply with the law. We may keep records showing when the material was sent, who sent it and what we did with it.

If we publish or broadcast the material, the content itself may become public even if the submitter’s identity does not.

Please only send material you are allowed to send us. If other people appear in it, think carefully about their privacy and safety before you hit send.

Please do not send material that is deliberately false, misleading, deceptively manipulated, threatening or otherwise unlawful. Serious cases may be referred to police or other authorities. We may remove, refuse, correct, preserve or disclose material where reasonably necessary to investigate, respond to complaints, protect people, or comply with legal obligations.

6. WHEN WE MAY SHARE INFORMATION

We may share personal information with:

– staff, contractors or volunteers who need it to do their work;
– service providers who help us host, secure, stream, analyse or support our website and services;
– social media, streaming or communications platforms when you interact with us through those platforms;
– professional advisers, insurers, regulators, courts, police, emergency services or other authorities where reasonably necessary or required by law;
– copyright owners or other parties where needed to verify rights or answer complaints;
– anyone else you have authorised or clearly agreed to involve.

We do not sell or rent personal information.

7. OVERSEAS SERVICES

Some of our website, email, streaming, analytics, security, social media and communications tools may be provided by businesses outside Australia or with infrastructure outside Australia. That means personal information may sometimes be stored, processed or accessed overseas.

Where we disclose personal information to overseas service providers, we will take reasonable steps to protect it and to work with providers that are appropriate for the job. Because providers and infrastructure can change, it is not always practical to list every country in advance.

8. SOCIAL MEDIA AND THIRD-PARTY PLATFORMS

If you interact with us through Facebook, streaming platforms, smart-speaker services or other third-party tools, their privacy rules also apply. Once you leave our website or interact directly with another platform, that platform is responsible for how it handles your information.

9. COOKIES AND SIMILAR TECH

Like most websites, we may use cookies, logs, pixels or similar tools to keep the site working, understand traffic, remember preferences, improve performance and protect the site from abuse.

Where the law requires consent for optional cookies or similar tracking, we will ask first. You can also manage cookies in your browser, although parts of the site may not work properly if you disable them.

10. SECURITY

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No system is perfect, but we use practical security measures appropriate to the type of information we hold and the way we operate.

If a serious data breach happens and the law requires notice, we will notify affected people and the relevant regulator as required.

11. HOW LONG WE KEEP INFORMATION

We keep personal information only as long as we reasonably need it for the reason we collected it, and for related purposes such as verification, complaints, corrections, legal compliance, record-keeping, archive purposes and safety.

As a general guide, ordinary contact messages may be kept for up to 24 months after the matter ends. Content submissions, verification records and complaint files may be kept longer where needed for publication records, archive purposes, legal issues or public-interest reporting. Published stories, photos, videos or broadcasts may remain in our archives, backups, search results or social posts even after they leave the front page.

When we no longer need personal information, we will take reasonable steps to delete it or de-identify it unless we are required or entitled to keep it.

12. MARKETING

We may occasionally send updates, promotions or station/news communications where you have asked for them, consented, or the law otherwise allows.

If we send marketing by email or SMS, we will identify ourselves and make it easy to unsubscribe. If you opt out, we will respect that.

13. YOUR CHOICES AND RIGHTS

You can ask us to:

– access personal information we hold about you;
– correct information that is inaccurate or out of date;
– withdraw consent where we rely on it;
– opt out of marketing;
– raise a privacy concern.

Where applicable law gives you additional rights, you may also be able to ask for deletion, de-identification, restriction, objection or data portability.

For published newsroom content, a privacy request does not automatically mean a story, photo or video will be deleted. Depending on the circumstances, the fairer and more lawful response may be a correction, update, annotation, limited redaction or de-identification.

Where practical, you can deal with us anonymously or using a nickname. But if you want a reply, a credit, a correction, a takedown, publication of your material or a formal complaint outcome, we may need enough information to identify or contact you.

14. KIDS

This website is for a general audience. If you are under 16, please ask a parent or guardian before sending us personal information or content. If you believe a child has sent us personal information inappropriately, please contact us so we can review it.

15. COMPLAINTS

If you have a privacy concern, contact us first and give us a fair chance to fix it.

Please tell us what happened, when it happened, and what outcome you are seeking. We aim to respond within 30 days.

16. CHANGES TO THIS POLICY

We may update this policy from time to time to reflect changes to our services, technology, legal obligations or the way we handle information. When we do, we will publish the updated version on this page and change the “Last updated” date.
